General terms and conditions for our long-term renters

In these General Terms and Conditions, terms such as ‘renter’ and ‘rental company’ are used as gender-neutral functional terms. They apply equally to all persons regardless of gender.

These General Terms and Conditions are accepted by the contracting parties as an integral part of the contractual relationship, regardless of whether this is concluded by a written rental agreement (e.g. business customers) or an order confirmation for a parking subscription (e.g. private customers). In addition, the currently valid version of the terms of use published on the website of the rental company shall apply. The renter confirms that he has read the terms of use and that he regularly informs himself of any changes.

The rental company shall provide the renter with a parking space on the terms and conditions set out in the underlying contract document (written rental agreement or order confirmation). The vehicle may only be parked within a marked parking space and must be equipped with a valid parking sign. It is forbidden to park motorcycles, bicycles, etc. on the premises of the car parks.

 

  • Carry out repairs or maintenance work on the vehicle.
  • To wash the vehicle.
  • To store items of all kinds, in particular fuels or car accessories.
  • Leave vehicles on the forecourt or on the driveway.

All car parks are accessed by means of automatic license plate recognition. To activate license plate recognition, the plate number(s) is recorded in the renter profile and is read out with the cameras and processed (automatically) when entering and exiting the car.

As a further means of access, a personal QR code is sent to the e-mail address specified by the renter. The QR code can be stored on the mobile phone as a PDF or in the Apple/Google Wallet. The QR code is to be used in particular when the license plate cannot be read (e.g. snow, hard-to-read plate numbers, etc.) and serves as an access medium for door/gate readers and/or for activating lifts.

If the car parks is fully occupied, the renter is still entitled to a parking space or access to the car parks specified in the contract. Any unoccupied parking space may be used, except parking positions reserved or blocked according to the appropriate designation, labelling or signage.

Subletting of the parking space in exchange for payment requires prior written approval from the rental company.

If necessary, up to four plate numbers may be deposited for the use of one parking space. Only one vehicle with one of the registered plate numbers may be present in the car park at a time. Vehicle owners and plate numbers must be notified to the rental company in advance. 

Renters use the car parks at their own risk. The liability of the rental company is waived to the extent permitted by law. In particular, the rental company is not liable for theft or damage caused to the parked vehicles by third parties. An insurance against damages of any kind is the responsibility of the renter. The renter is liable for all damages caused while using the car park or because of non-observance of contractual or legal requirements. 

 

The charging process can be activated by a supported charging card (RFID) or by scanning the QR code on the charging station via the installed charging app. If neither a charging card nor a charging app is available, the QR code on the charging station can also be scanned. After depositing the credit card details, the charging process starts.

Renters who do not have a monthly subscription including electricity pay the end consumer price, which is determined by the respective charging card provider or operator (e.g. Swisscharge, TCS, Autosense charge:on etc.). The renter is responsible for informing himself about the costs and charges incurred.

The renter is responsible for complying with the necessary technical and legal requirements/regulations in order to be able to start the charging process at a charging station (e.g. mobile phone, active data connection, suitable charging cable, etc.).

The renter acknowledges that the charging capacity depends on the number of vehicles using electricity and may therefore vary, which may affect the duration of the charging process. The renter is not entitled to a minimum power (kW). Charging stations are signposted accordingly in the car parks.

The renter can choose between individual monthly subscriptions excl. and partly incl. electricity in each car park.

The monthly subscription entitles the renter to use the car park during the period of use specified in the contract document or up to the maximum period of use specified. Unused time expires without compensation and will not be taken over in the following month.

If the period of use specified in the respective contract document is exceeded or the car parks is used outside the agreed period of use, this additional parking time will be billed in the following month at the fixed tariff rates and invoiced separately, but no later than at the end of the lease.

In the case of the monthly subscription including electricity, a charging card in accordance with this section 7.1 is included in addition to a parking space (see section 7).            

For the purchase of additional charging cards (maximum 3 cards), the renter will be charged a one-off CHF 35 per charging card. In addition, a monthly fee (which will be notified to the renter at the latest upon request) will be charged for each additional charging card plus the subscription fee.

Each charging card includes electricity consumption at charging stations in the agreed car park to the extent of the agreed kWh package per month. Each additional kilowatt hour is charged at the specified kWh price and charged separately to the renter on a monthly basis.

The rental company has the right at any time to change the included charging capacities (kWh package) as well as the prices for electricity consumption not included in the kWh package. Such changes are notified 30 days in advance in writing by letter or e-mail.    

The AMAG Group determines tariff and product-related public holidays for each canton. There are a total of nine public holidays per calendar year per canton.

The subscription fee is based on the underlying contract document. In the event of a change in the originally agreed period of use, the monthly subscription fee will be recalculated retroactively from the start of the rental on the basis of the actual period of use. The subscription fees applicable to the respective car park, as indicated on https://parking.amag.ch/en/parkhaus.html and its car park subpages, will apply.

Any changes in the VAT rate entitle the rental company to adjust the subscription fee to the same date, whereby the rental company shall inform the renter in writing or by e-mail in good time.

In addition, the rental company has the right to adjust the subscription fee and its conditions at any time. An adjustment will be announced by e-mail in compliance with the contractually stipulated notice period.

The subscription fee is due in advance and must be paid at the latest on the last day of the previous month. The subscription fee and additional charges (e.g. charging cards, extra parking time, etc.) will be invoiced to the renter monthly by e-mail with PDF invoice.

If a confirmed contractual relationship is cancelled or not commenced less than 14 days before the start of use, a turnover/cancellation fee of CHF 150 will be charged. Irrespective of the form of contract conclusion.

An indefinite contractual relationship of retail customers may be terminated by giving notice of one month from the end of each calendar month.

An indefinite contractual relationship of business customers may be terminated by giving notice of three months from the end of each calendar month.

Any termination must be made in writing or by e-mail and must be received by the counterparty no later than the last day before the beginning of the notice period.

A fixed-term contractual relationship ends automatically upon reaching the end date, without the need for termination. Early termination is not possible. If the renter wishes to extend the fixed-term rental relationship, he must notify the landlord by e-mail no later than 7 days before reaching the end date.

In the event of a breach of the provisions of the general terms and conditions, the conditions of use of the car park or legal provisions, the landlord may refuse the renter access to the car park or block the renter’s access medium and, if necessary, issue a house ban against the offending person. Violations of legal provisions may be reported by the landlord.

In the event of payment arrears, the landlord is entitled to set the renter a period of ten days for payment by e-mail under threat of termination in the event of unused expiry of the period and to terminate the lease without notice after unused expiry.

The renter’s personal data and the license plate number are stored in the car park’s local database and is processed in compliance with the currently applicable statutory data protection requirements. Further information on data protection can be found in the respective version of the privacy policy published on the rental companies’ website.

The absence of the renter or non-use of the car park or parking lot does not justify a reduction in the subscription fee. The rental company is permitted to affix a license plate to the vehicles authorized to park. Vehicles without license plates may only be parked with the rental company’s permission. The renter may not offset any counterclaims. The renter undertakes to follow all instructions of the operating personnel.

The place of jurisdiction for any disputes arising from this rental agreement is the location of the rented parking space. The provisions of Swiss tenancy law (Art. 253 et seqq. Swiss Code of Obligations) apply to the rental agreement.

There are no verbal agreements. The rental company reserves the right to amend these GTC at any time and without stating reasons. The rental company shall notify the renter of forthcoming amendments in good time. Amendments to these GTC shall become part of the contract if the rental company does not expressly object to the amended GTC within fourteen (14) days of notification of the amendment. In the event of a rejection of the amended GTC by the rental company, the renter reserves the right to terminate the contractual relationship at the end of any month, subject to a notice period of one month.
